In a split decision, Alberta’s top court ruled Suncor Energy cannot go ahead for now with its plan to randomly test thousands of it’s employees for drugs and alcohol.

Last October, the Communications, Energy and Paperworkers union won an injunction against the testing with a judge ordering the matter be settled by arbitration.

Suncor took the matter to the Alberta Court of Appeal, where two of three judges ruled the matter must proceed to arbitration.

Justice Jean Cote called Suncor’s plans for drug testing a significant break of worker’s rights.

The President of the Alberta Federation of Labour, Gil McGowan tells 660News, the court got it right.

McGowan says there have been a number of studies south of the border, that prove random drug testing does not improve jobsite safety.

He says the best way to protect workers is through better education, supervision and tougher government regulations and enforcement.
