Charges have been upgraded against one of the suspects in the random beating death of 49 year old John Fernando Herrera-Garcia.
Garrett Elliott Lee Smith is now charged with second degree murder, after Herrera died from his injuries several months after being attacked in the Beltline on 6th street southwest.
Two other suspects were charged with attempted murder, Jarod Donald Henry, 22, and Chantelle Tiffany Campbell, 27, and the Crown has recommended charges be upgraded against them as well.
Herrera’s children say their father was supportive and eager in his quest for knowledge.
21-year-old David Herrera-Garcia says his family holds no ill will towards the accused. “Who am I to judge you know, I don’t know what the circumstances, I don’t know anything about them, all I cared about was my dad’s health.”
Police believe Herrera was returning home from buying groceries when he was attacked.
He is the city’s 10th murder victim of the year.
His funeral will be held Friday.
